Our Services

Oklahoma Indian Legal Services supports the Oklahoma Native community by providing free legal representations to tribal members on a variety of cases. Call today to speak with a trained legal intake specialist and apply for services.

Expungements

Expungement is a legal process through which criminal records are sealed or erased, effectively removing them from public view - including potential employers, landlords, and others. 


The eligibility criteria for expungement differ by state or tribe; however, in Oklahoma, there are 17 distinct pathways to qualify for sealing both felony and misdemeanor records. You may be eligible for this process.

Criminal Defense

 OILS is able to provide a free criminal defense attorney for charges in Tribal Court. Native Americans are vastly overrepresented in the criminal-legal system, and since many attorneys are not qualified to practice in Tribal court, Natives aren't always able to acquire quality counsel. Sovereignty

 Attacks against tribal sovereignty still occur. OILS is available for low-income tribes to help them protect their rights & keep their sovereignty strong. OILS can also help tribes rewrite legal codes & constitutions to reflect the realities of modern tribal government. 

ICWA

 OILS works to represents members of federally recognized tribes in cases where children have been removed from their parents or guardians by the state or another third party. We also represent enrolled tribal members people in adoptions or guardianships. 


In addition, we publish the Indian Child Welfare Act: Case, Regulation & Analysis which serves as a valuable tool for attorneys nationally when dealing with cases related to the Indian Child Welfare Act. The book contains detailed analysis of cases from across the nation & is current through June 2017. 

Housing

 Oklahoma has the highest number of Indian housing units in the US & OILS provides protection to homeowners facing unfair changes to their living situations. OILS also assists those dealing with quality of habitat issues like required repairs, radon gas, or mold problems.  

Estate Planning

 OILS works to ensure that Indian country stays in Indian hands by clearing title to restricted land & preparing wills for Indian senior citizens. Over 75% of restricted land titles in eastern Oklahoma don't have clear ownership of the title. OILS's work has helped move over $750,000 from deceased landowners to their heirs in the last three years alone. They also conduct wills clinics & protect mineral interests, including seeking redress for right-of-way violations on Kiowa trust lands.
